Do You Need a Will?
Many people are told that if you do nothing else to take care of your legal affairs, you should at least write a will. That is pretty good advice. Having a will, which is properly drafted in accordance with the law of the state in which you reside, provides several assurances. They include:
- Leaving your property to the people and organization you choose.
- Naming your Personal Representative. The person with the authority to make sure that the terms of your will are carried out.
- Allowing you to select the person who will serve as a guardian for your minor children or any adult with special needs.
- Allowing you to select the person who will oversee assets left for children until they reach a given age if the assets are put into a trust.

In the absence of a will, the state will resort to a formula. A judge will name an executor, bond may have to be posted, the court will name a guardian and a formula will determine asset distribution. |
